1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and phatay Casino ("phatay," "we," "us," or "our"), governing your access to and use of the phatay online gaming platform available at phatay.club and all associated subdomains, mobile interfaces, and applications (collectively, the "Platform").

By registering an account, accessing the Platform, or placing any wager on phatay, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms, together with phatay's Privacy Policy and Responsible Gaming Policy, all of which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease using the Platform.

These Terms apply to all users of phatay Casino, including visitors, registered Players, and any other person who accesses or uses the Platform for any purpose. Your continued use of the Platform following any amendment to these Terms constitutes acceptance of the revised Terms.

2. Eligibility

Any account found to be held by an individual under the age of 21 will be immediately suspended and all funds will be handled in accordance with applicable PAGCOR regulations.

2.2 Geographic Eligibility

phatay Casino is operated for and directed at Filipino players in the Philippines. It is your sole responsibility to ensure that online gambling is lawful in your jurisdiction of residence before accessing the Platform. phatay makes no representation that the Platform is appropriate or available for use in jurisdictions outside the Philippines.

2.3 Excluded Persons

The following persons are not eligible to register or maintain an account at phatay Casino:

• Persons under 21 years of age;
• Employees, contractors, or agents of phatay Casino or its affiliated companies, or their immediate family members residing in the same household;
• Persons who have self-excluded from phatay Casino or from any other PAGCOR-licensed gaming operator;

3. Account Registration

3.1 One Account Per Player

Each individual may register and maintain only one (1) phatay Casino account. The creation of duplicate, multiple, or fraudulent accounts is strictly prohibited. phatay reserves the right to merge, suspend, or permanently close duplicate accounts and to void all associated transactions, including withdrawals pending at the time of discovery.

3.2 Accurate Information

You must provide complete, accurate, and current personal information during the registration process and maintain the accuracy of that information throughout the duration of your phatay account. This includes your full legal name, date of birth, registered Philippine mobile number, and residential address. phatay is entitled to request documentary evidence of the information provided at any time.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your phatay login credentials, including your username, password, and any one-time passwords (OTPs) sent to your registered mobile number. You agree to notify phatay immediately if you suspect any unauthorised access to or use of your account. phatay will not be liable for any loss arising from your failure to maintain the security of your login credentials.

3.4 Know Your Customer (KYC) Verification

phatay conducts mandatory KYC verification on all accounts prior to the processing of the first withdrawal request. KYC may also be triggered at any time by unusual account activity or high-value transactions. Failure to provide satisfactory KYC documentation within the period specified by phatay may result in account suspension and the withholding of withdrawal requests pending completion of verification.

4. Deposits

phatay Casino accepts deposits via GCash, Maya (formerly PayMaya), BPI, BDO, UnionBank, 7-Eleven Cliqq, USDT TRC20, and Coins.ph. The minimum deposit amount is Philippine Peso (PHP) ₱100. All deposits are credited in Philippine Peso. phatay does not accept deposits from third-party payment accounts — the account name must match the registered phatay Casino account holder.

phatay does not charge fees on standard deposits. Transaction processing times vary by payment method. GCash and Maya deposits typically clear within sixty (60) seconds. Bank transfers may take up to three (3) hours depending on the issuing bank and time of transaction.

phatay reserves the right to refuse, reverse, or withhold any deposit that it has reasonable grounds to believe is associated with fraudulent activity, money laundering, or any other prohibited conduct as defined in these Terms or under applicable Philippine law.

5. Withdrawals

Withdrawal requests may be submitted at any time from your phatay account dashboard. Withdrawals will only be processed to a payment account registered in the name of the verified phatay account holder. Third-party withdrawals are strictly prohibited.

Standard withdrawal processing times are as follows: GCash and Maya withdrawals are typically processed within ten (10) minutes of approval; BPI, BDO, and UnionBank bank transfers are processed within one (1) to three (3) hours; USDT TRC20 withdrawals are processed within thirty (30) minutes. These timeframes are targets and may be extended during periods of high platform volume or when additional verification is required.

phatay reserves the right to perform additional identity verification checks before approving withdrawal requests above certain thresholds, as required by PAGCOR anti-money laundering (AML) compliance obligations. Players who have not completed KYC verification cannot process withdrawals.

6. Bonuses & Promotions

phatay Casino may from time to time offer bonuses, promotional credits, free spins, and other incentives to eligible Players ("Promotions"). All Promotions are subject to specific terms and conditions communicated at the time of the Promotion, including wagering requirements, eligible games, minimum odds, and expiry periods. Those specific terms are incorporated into and form part of these Terms.

Bonus funds and winnings derived from bonus funds may not be withdrawn until applicable wagering requirements have been met in full. Wagering requirements must be fulfilled within the time period specified for each Promotion. Incomplete wagering will result in forfeiture of remaining bonus balances.

phatay reserves the right to modify, suspend, or withdraw any Promotion at any time without prior notice. Players who are found to have abused Promotions — including through the use of multiple accounts, the creation of fictitious accounts, or the exploitation of technical errors — will have their accounts suspended and all associated bonuses and winnings forfeited.

7. Game Rules & Fair Play

All games available on the phatay Casino platform operate using a Random Number Generator (RNG) that has been independently certified and is subject to regular third-party audit. The RNG ensures that all game outcomes are entirely random and cannot be predicted, influenced, or manipulated by any party, including phatay.

Published Return to Player (RTP) percentages are theoretical long-term averages calculated over millions of game rounds. Individual session results will deviate from published RTP figures. Past results do not indicate or guarantee future outcomes in any phatay game.

In the event of a technical error, malfunction, or interruption during a game round, phatay reserves the right to void the affected round and return the wager amount to the Player's account. phatay's decisions on game disputes are final, subject to the formal dispute resolution procedure available through PAGCOR.

8. Prohibited Conduct

The following conduct is strictly prohibited on the phatay platform and will result in immediate account suspension, forfeiture of funds, and where applicable, referral to relevant Philippine law enforcement authorities:

• Using automated software, bots, scripts, or any other artificial means to place wagers or interact with the Platform;
• Engaging in fraudulent, dishonest, or collusive activity of any kind, including chip dumping in live casino games;
• Exploiting software errors, technical glitches, or vulnerabilities to gain an unfair advantage;
• Depositing funds obtained through illegal means, including theft, fraud, or money laundering;
• Providing false or misleading information during registration or verification;
• Attempting to access another Player's account without authorisation;
• Engaging in any activity that disrupts, damages, or interferes with the Platform's operation or the gaming experience of other Players.

9. Responsible Gaming

phatay Casino is committed to the promotion of responsible gambling among Filipino players. We recognise that gambling can become problematic for some individuals and are committed to providing tools and resources to support healthy gambling behaviour.

All phatay accounts include access to the following responsible gaming tools, available from the account settings dashboard:

• Cooling-off periods ranging from twenty-four (24) hours to thirty (30) days;
• Permanent self-exclusion from the phatay platform.

Self-exclusion requests are processed immediately and are irrevocable for the duration of the elected exclusion period. 10. Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial gaming purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content from the phatay platform without the prior written consent of phatay.

11. Limitation of Liability

To the maximum extent permitted by applicable Philippine law, phatay Casino, its directors, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of or inability to use the Platform.

phatay's total aggregate liability to any Player in connection with any single claim or series of related claims arising under or in connection with these Terms shall not exceed the aggregate net deposits made by that Player to phatay in the thirty (30) days immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude phatay's liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded or limited under applicable Philippine law.

12. Privacy

phatay Casino collects, processes, and stores your personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By registering an account at phatay, you consent to the processing of your personal data as described in the Privacy Policy. The Privacy Policy sets out the types of data collected, the purposes for which it is processed, the parties with whom it may be shared, and your rights as a data subject under applicable Philippine data protection legislation.

13. Termination

phatay reserves the right to suspend or permanently terminate your account at any time, with or without prior notice, if phatay determines in its sole discretion that you have breached any provision of these Terms, engaged in prohibited conduct, or if required to do so by applicable law or by a PAGCOR regulatory directive.

Upon termination of your phatay account for any reason, any balance remaining in your account will be handled in accordance with PAGCOR guidelines and phatay's internal procedures. In the event of termination for breach of these Terms, phatay reserves the right to withhold and forfeit any funds associated with prohibited conduct.

You may close your phatay account at any time by contacting phatay Customer Support. Account closure does not affect any rights or obligations that have accrued prior to the date of closure.

14. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them — including any non-contractual disputes or claims — shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

In the event of any dispute between you and phatay arising from or in connection with these Terms or the use of the Platform, the parties shall first attempt to resolve the dispute informally by contacting phatay Customer Support. If the dispute cannot be resolved informally within thirty (30) days, either party may refer the matter to PAGCOR's dispute resolution process, or to the courts of competent jurisdiction in the Philippines.

15. Amendments

phatay Casino reserves the right to amend, update, or replace these Terms at any time. When material amendments are made, phatay will notify registered Players by posting the updated Terms on the Platform and, where practicable, by sending a notification to the registered email address or mobile number associated with your account.

The date of the most recent revision is displayed at the top of this page. Your continued use of the phatay platform following the posting of amended Terms constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must immediately cease using the Platform and contact Customer Support to close your account.
